Hy-Fan Product Warranty Terms

Sole and Exclusive Remedy

If any Hy-Fan product develops a defect in manufacturing, material, or workmanship, and a valid claim is received within thirty (30) calendar days following the end of the Warranty Period, Hy-Fan has the discretion to either replace the product with a new or refurbished unit. "Refurbished" means the product is restored to its original specifications. Hy-Fan may also replace the product with a similar style or an equivalent substitute, subject to availability. Efforts will be made to replace limited edition or specialty products, but their availability for replacement is not guaranteed. In cases where an identical product is unavailable, a similar model will be provided based on what's available. Exact color matches cannot be guaranteed. Replacements or repaired products are covered for the remainder of the original Warranty Period. This is the customer's sole and exclusive remedy, extended only to the original end-use customer and not transferable.

Exclusions and Limitations

The customer assumes all risks regarding the quality and performance of Hy-Fan products after purchase. This warranty does not cover defects from normal wear and tear, cosmetic damage (including scratches and dents) unless caused by a defect in manufacturing, materials, or workmanship, improper use, failure to follow instructions, accidents, damage from external causes like fire or natural disasters, power surges, unauthorized alterations, damages from inadequate packing or shipping, loss or corruption of data, or damages from using non-Hy-Fan products. It also does not apply to products that need modifications for use in countries other than those for which they were designed, or for products purchased from unauthorized dealers. This warranty complements rights under applicable consumer protection laws or regulations, which may provide additional warranties or remedies for defects. Provisions of this warranty conflicting with such laws or regulations do not apply to customers covered by them.

Warranty Disclaimers

Each Hy-Fan product is provided "as is" and Hy-Fan disclaims all other warranties, whether express, implied, or statutory, including but not limited to warranties of non-infringement, merchantability, or fitness for a particular purpose. The duration of any implied warranty is limited to the Warranty Period specified above. Some jurisdictions do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to all customers. If local law requires a minimum warranty period longer than the one set forth here, the warranty period will be extended to meet those requirements.

Limitation of Liability

Hy-Fan, its distributors, or suppliers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from the use or inability to use any product. This includes, but is not limited to, damages to property, loss of product value, loss of use, or any damage to electronic devices or personal property contained in or used with the products, or data loss. The total liability of Hy-Fan and its affiliates is limited to the amount paid by the customer for the product. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so these limitations or exclusions may not fully apply.

Warranty Claim Process

To make a warranty claim, visit Hy-Fan's warranty page no later than thirty (30) calendar days after the Warranty Period's expiration. Customers may be asked to provide a photograph of the product for claim validation and, in some cases, return the product to Hy-Fan for inspection. Hy-Fan reserves the right to charge a shipping and handling fee for processing warranty claims.
